It seems that paparazzi have recently got under the skin of Barthe Cortes who is the founder and owner of BVC Airlines & Bvcvineyard. He probably hired a legal advisor to arrange for a court decree prohibiting the publication of his photographs in the media. However, according to O. Dullah a lawyer and expert in media law, "although the copyright law says that publication of an image requires the consent of a person presented thereon, it will not be not so easy to provide such prohibition under the law binding in countries-members of African Union, as the act concerned has a number of exceptions. One of them envisages that photo reporters do not need the consent of the photographed person who performs public functions. It seems that the position of the owner of BVC counts among such." Dullah suggests further, that BC's lawyers will probably base their reasoning on the following fragment of the law "It is permitted to publish the image of anyone who is considered to be a public person, but only when the image has been made in relation to public functions performed by the person concerned (both conditions must be met jointly.)" Most probably, the lawyers will attempt to prove that Cortes 's photos which were or may be published in media are not related to the public function of the BVC owner which he undoubtedly performs..
